Samplia Media, S.L. (hereinafter, Samplia or the Owner, interchangeably), with VAT B65964074 and address at Calle Resina 59J, 28021, Madrid, registered in the Mercantile Registry of Barcelona, Volume: 35719, Folio: 161, Section: 8, Sheet: 641895, is the owner of the Samplia Application (hereinafter, the Application or the App, interchangeably).

Samplia makes the App available to any User who, in compliance with the conditions of the App's user license set out below (hereinafter, the General Conditions and User License), downloads and installs it on their mobile device, with the primary purpose of obtaining free product samples from different brands.

General Conditions and User License of the Samplia App

  1. Identification of the parties
    These General Conditions and User License compiled here are subscribed on the one hand by the Owner and on the other by you, as a natural person User, of legal age, who freely and voluntarily downloads, installs, or accesses the App, regardless of whether or not you use the services and tools offered there at any time.
    The User, by accessing, downloading, or installing the App, accepts these Conditions insofar as they may apply to any Internet User who simply downloads the App. When additionally registering, the User accepts them, declares to be of legal age according to Spanish legislation, and submits unreservedly to everything stipulated herein. Furthermore, the User accepts that only one single user account is allowed per person.
    The Owner recommends a careful reading of this document, as well as periodic review of its content.

  2. Object of the App
    The main purpose of the App is the provision of a platform aimed at promoting third-party products through which Users, in exchange for entering their data and answering a survey, can access free product samples from the different brands Samplia collaborates with, either through certain establishments or through Samplia machines installed in shopping centers.
    Downloading, accessing, and using the App, as well as obtaining the promoted product, are free. Samplia reserves the right to offer promotional codes, always on an individualized basis, at any time.
    The App is designed to be used on devices with Internet access. However, the App does not include access to the Internet or mobile networks, so the User must pay the rates of their corresponding Internet or mobile provider.

  3. How the App works
    To download free products from the campaigns regularly offered by Samplia, the User must download the Samplia App and have an Internet connection.
    With the active Samplia App and duly registered, the user must go to the Samplia machine or the establishment/point of sale provided by Samplia of their preference to download the free product.
    Once at the machine or establishment, the User must follow the usage instructions. Usually, this involves providing a code obtained in the App and entering it into the Samplia machine or exposing it at the establishment.

  4. User Obligations
    The User commits to:

    • Make diligent, correct, and lawful use of the App, complying with current legislation.
    • Not create multiple user accounts associated with the same person or device code.
    • Periodically review these Conditions.
    • Not damage, disable, overload, or hinder the service.

  5. Intellectual/Industrial Property and User License
    Samplia grants the User non-exclusive usage rights to the App, with no possibility of assignment or sub-license, worldwide, and for all the time the App remains installed on the User's device.
    This usage license does not imply the assignment of any intellectual or industrial property right over the App or any content present in it.

  6. Exclusion of Liability
    Samplia works so that the App's services and functionalities are always available. However, the App will be shown "as is", according to availability and concurrent limitations at any time.

  7. Data Protection
    The collection and processing of the User's personal data is governed by a specific Privacy Policy accessible from the App's user panel. At any time, the User may modify their data, cancel their account, or exercise their privacy rights by contacting info@samplia.com.

  8. Modifications
    These Conditions may be modified and/or updated at any time without prior notice. Substantial changes will be communicated in advance to Users.

  9. Legislation and Jurisdiction
    Relations between Samplia and the User will be governed by Spanish law. Being a consumer and/or user, any conflicts will be submitted to the Courts and Tribunals of the User's domicile. Otherwise, to the Courts and Tribunals of Madrid.
